Class action against Louisiana-Pacific Corp.

Keith Russell of the Tennessean is reporting that the class action status of a suit against Louisiana-Pacific Corp has been upheld:

A California judge has upheld the class-action status of a lawsuit against Louisiana-Pacific Corp. over defective shingles sold nearly a decade ago by the Nashville-based building materials company.

The case was originally filed in January 2001 on behalf of 5,300 homeowners who allege that Louisiana-Pacific sold defective Nature Guard brand shingles from 1995 to 1998. According to their attorneys, the owners are seeking $100 million for the cost of replacing all of their roofs, plus punitive damages.

Louisiana-Pacific has denied the allegations and said it has a 25-year warranty program for homeowners who may have bought defective shingles.

The company sought to de-certify the case’s class-action status but saw its motion denied by a judge in Superior Court of California on Wednesday. A trial date has been set for Dec. 6.

A Louisiana-Pacific spokeswoman said the company plans to defend itself “vigorously” during the trial.

    I HAD LOUISANA PACIFIC NATURE GUARD BRAND SHINGLES INSTALED ON MY HOUSE IN 1998. THE HOUSE SHOULD BE REROOFED NOW, BUT AM HANGING ON TO SEE WHAT TRANSPIRES WITH THIS LAW SUITE. THIER ARE DOZENS OF SHIGLES THAT HAVE BROKEN.
